Use by Special Review (USR) Cherry Valley Event Venue, US2021-003

 On August 9, 2022, the Douglas County Board of County Commissioners (BOCC) approved a Use by Special Review for an event center on 6.7 acres of 35.387 acres of A-1 zoned property located at 8635 South State Highway 83, Franktown, Colorado 80116.  When approving the Event Center USR, the BOCC disregarded the Douglas County Zoning Resolution and the Comprehensive Master Plan, setting precedent by which future developers could exploit Douglas County’s rural landscape and destroy it in the process.  The Event Center USR does not meet setback, buffer, or noise study requirements, or uphold the character of rural communities.  Per the Event Center USR decision, Douglas County projects no longer need to meet these thresholds for development.


As such, a complaint was filed by community members under Rule 106 in District Court on September 2, 2022.  Winning this court case to reverse the USR is important to all Douglas County residents as it upholds the Douglas County Zoning Resolution and the Comprehensive Master Plan.  The county responded on September 27, 2022 and the applicants responded on September 28, 2022.  The county provided the record for the USR application in late October 2022 and the Opening Brief was submitted by the community’s attorneys on December 16, 2022.  The attorneys for the county and applicants submitted responses January 20, 2023, and the community’s attorney submitted a final response on February 2, 2023. A decision by a district court judge is now pending. Upon a decision, an appeal could be pursued by either party. Donations to Cherry Valley Community Action are being accepted to help fund this initiative.
